Scott Alan Miller
Firm Member
Scott Alan Miller is a shareholder of the firm in the litigation department. Mr. Miller’s practice focuses on trials, arbitration and mediation, principally in the areas of business, real estate and employment. Mr. Miller also is chair of the firm’s Environmental Sustainability Committee, vice chair of the firm’s Real Property Practice Group, and a member of the firm’s Recruiting Committee.
Education Background
Mr. Miller received his B.A. in history from the University of California, San Diego in 1993. He earned his law degree, magna cum laude, from the University of San Diego School of Law in 1997, where he was named to the Order of the Coif.
Representative Matters
Business
- Obtained defense verdict and recovery of attorneys’ fees for a local charter airline business in bench trial involving breach of contract, fraud and other tort claims
- Successfully represented purchasers of local business against seller in breach of contract and fraud claims
- Represented German telecommunication company in arbitration with California manufacturer
- Obtained defense judgment and attorneys’ fees for internet company and its founders from fraud claim brought by investor
- Successfully represented oil and gas company in breach of contract, trade secret and securities litigation
- Successfully represented individuals and businesses in partnership disputes
- Obtained a dismissal for financial institution against local business in breach of contract claim and successfully represented the financial institution before the California Court of Appeal
- Represented trustee/beneficiary and other family members in trust disputes and probate litigation
Real Estate
- Obtained favorable verdict and attorneys’ fees for property owner in complex easement dispute with neighbor in four-week bench trial
- Obtained a dismissal and attorneys’ fees for owners of an apartment complex sued by tenants claiming personal injury from exposure to toxic mold
- Obtained judgment and attorneys’ fees for developer in breach of contract and fraud claim over the sale of recreational rights to private lake
- Defended home builders in complex construction defect litigation, including multi-million dollar landslide case
- Represented home buyer in dispute with seller for failure to disclose concealed defects and mold damage
Employment Law
- Defended airline from a wrongful termination claim in a six-week jury trial
- Counseled businesses regarding employee dispute and benefit issues
