Tracy A. Warren

Firm Member

Tracy A. Warren is a shareholder of the firm and her practice emphasizes employment counsel and litigation, business defense and litigation, religious entity defense, appellate practice, sports negotiation as well as health care and medical malpractice defense.

She has appeared before the California Court of Appeal, the San Diego and Los Angeles Superior Courts, the United States District Court Southern District of California, the Department of Fair Employment and Housing, the Division of Labor Standards Enforcement, the Unemployment Insurance Appeals Board, the Division of Occupational Safety and Health (Cal/OSHA),  JAMS California and Philadelphia, Alternate Dispute Resolution (ADR), the Superior Courts of New Jersey and the Circuit Courts of Maryland.  Ms. Warren is admitted to the United States Supreme Court, the California, New Jersey and Maryland courts.

Education

Ms. Warren received her B.A., magna cum laude, from the College of New Jersey in 1987 where she was inducted into the Academic All-American Hall of Fame.  In 1989, she earned her masters in journalism from Temple University and her juris doctor from the University of Notre Dame in 1999.

Employment Background

Ms. Warren joined Seltzer Caplan McMahon Vitek in 2006 following several years of practice in both Maryland and California. Prior to her legal career, Ms. Warren was an Emmy award-winning sports broadcaster.

Representative Matters

  • Defended and counseled various national and local, profit and non-profit employers in the financial, medical, educational, athletic, electronic media, social services, religious, hotel and veterinary industries against wrongful termination, sexual harassment, age, sex, disability and age discrimination claims, wage and hour, trade secret and non-compete claims
  • Represent school vice presidents, teachers, and students in issues ranging from termination, to workplace investigations and reinstatement
  • Defended and counseled multinational non-profit entity in employment issues, harassment investigation, and residential housing matters
  • Obtained summary judgment and dismissal of the complaint for all six defendants as to all eight causes of action in a wrongful termination, defamation, race and national origin discrimination claim against a mental health provider and its employees
  • Obtained summary judgment and dismissal of the complaint for all five defendants as to all seven causes of action in an employee termination case including claims of defamation, inducing breach of contract, intentional interference with prospective economic advantage and breach of the covenant of good faith and fair dealing against a child mental health facility and its employees
  • Counseled and defended religious non-profit institutions in employment, teacher/student matters, safety and abuse issues, vexatious litigant litigation, as well as general business matters
  • Defended and counseled higher education institution in Office of Civil Rights investigation
  • Successfully defended east coast and mid-west employers in wage and hour class action litigation
  • Represent and counsel over fifty collegiate coaches in the negotiation of coaching contracts, sporting manufacturer and apparel contracts, television and movie contracts as well as provide counsel related to student athlete, administration and National Collegiate Athletic Association matters, termination issues and buyouts
  • Counsel and defend medical and veterinary doctors in malpractice and medical board litigation as well as employment litigation
  • Represent various employers before the Division of Labor Standards Enforcement, Department of Fair Employment and Housing, the Equal Employment Opportunity Commission, the Unemployment Insurance Appeals Board and the Division of Occupational Safety and Health (Cal/OSHA)
  • Successfully defended manufacturing company in product liability and personal injury litigation
  • Successfully defended college and administrators in claims of defamation and invasion of privacy resulting in dismissal of the lawsuit
  • Successfully defended international bicycle racing company in claims for breach of contract
